1. The update of 8.6 Anima Model and NVIDIA Cosmos Flow-Through Terms.

8.6 Anima Model and NVIDIA Cosmos Flow-Through Terms. Certain Models offered through the Service are marked “Built on NVIDIA Cosmos” and include the “Anima” model family licensed by CircleStone Labs LLC (the “Anima Models”), which are derivatives of NVIDIA Cosmos-Predict2 distributed under the NVIDIA Open Model License Agreement (the “NVIDIA OMLA”). When you access, use, generate with, or otherwise interact with any Anima Model or any Model marked “Built on NVIDIA Cosmos” (each, a “Cosmos-Derived Model”) through the Service, you additionally acknowledge and agree, on top of all other provisions of these Terms, that: (i) you are bound by NVIDIA’s Trustworthy AI terms as incorporated by reference into the NVIDIA OMLA, and a copy of the NVIDIA OMLA is made available to you at the link above; (ii) you will not use any output of a Cosmos-Derived Model to train, fine-tune, or distill any model that is competitive with the Anima Models; (iii) you will not, and will not permit any third party to, alter or remove copyright or other proprietary notices appearing on or in any Cosmos-Derived Model, nor circumvent, disable, or remove any safety mechanism, content filter, watermark, usage restriction, or other guardrail incorporated into a Cosmos-Derived Model by CircleStone Labs LLC, NVIDIA, or Civitai; (iv) you will not use a Cosmos-Derived Model or any output thereof (A) to infringe, misappropriate, or otherwise violate any third party’s rights, including rights of publicity or “digital replica” rights, (B) for any unlawful, fraudulent, defamatory, or abusive activity, (C) to generate child sexual abuse material or non-consensual intimate imagery, or (D) in any manner that violates applicable laws, rules, regulations, or export controls; (v) you will not download or use any Cosmos-Derived Model if you are located in a comprehensively sanctioned jurisdiction, are listed on any U.S. or non-U.S. restricted parties list, or for any purpose prohibited by U.S. or non-U.S. export control or trade sanctions laws; and (vi) the disclaimers of warranties and limitations of liability set forth in these Terms apply to your use of all Cosmos-Derived Models and their outputs. A copy of the CircleStone Labs LLC commercial license governing the Anima Models is linked from each Anima Model page on the Service. The foregoing restrictions are in addition to, and do not limit, any other restrictions set forth in these Terms or in the applicable Model license.
